These Terms of Service ("Terms") govern your access to and use of the websites and services provided by Ventix AI ("Ventix," "we," "us," or "our"), including our AI voice-agent platform. By accessing our site or using our services, you agree to these Terms. If you do not agree, do not use the services.
What Ventix provides
Ventix provides AI voice agents that call, qualify, and book real-estate leads, along with related integrations such as CRM sync and calendar scheduling. The specific scope, pricing, and configuration of any engagement are set out in a separate order form, statement of work, or written agreement ("Order"). If an Order conflicts with these Terms, the Order controls for that engagement.
Eligibility and accounts
You must be at least 18 years old and able to enter a binding contract to use the services. You are responsible for the accuracy of the information you provide and for activity carried out under your account.
Your compliance responsibilities
If you use Ventix to contact your leads, you are the party initiating those communications and are responsible for using the services lawfully. This includes, without limitation:
- Having a valid legal basis and any required prior express consent to call, text, or record the individuals you contact.
- Complying with the Telephone Consumer Protection Act (TCPA), state telemarketing and call-recording laws, Do-Not-Call requirements, and applicable calling-time and frequency restrictions.
- Maintaining and honoring opt-out and do-not-call requests, and providing accurate, lawfully obtained lead data.
- Providing any notices and disclosures your jurisdiction requires for automated or recorded calls.
Ventix provides tooling and reasonable controls to support compliant calling, but we do not provide legal advice, and you are responsible for determining what the law requires for your use.
Acceptable use
You agree not to use the services to send unlawful, deceptive, harassing, or fraudulent communications; to violate any person's rights; to attempt to disrupt or reverse engineer the platform; or to use the services in any way that violates applicable law or these Terms.
Fees and payment
Fees are as stated in your Order. Unless stated otherwise, fees are non-refundable and exclusive of taxes. Late or failed payments may result in suspension of the services.
Service availability and changes
We work to keep the services available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features from time to time.
Intellectual property
Ventix and its licensors own the platform, software, and all related intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the services during your engagement. You retain ownership of the data you provide, and you grant us the rights necessary to process that data to deliver the services.
Third-party services
The services rely on third-party providers (such as telephony, voice, AI model, scheduling, and CRM providers). Your use of those integrations may be subject to their terms, and we are not responsible for third-party services.
Confidentiality
Each party agrees to protect the other's non-public business information disclosed in connection with the services and to use it only as needed to perform under these Terms.
Disclaimers
The services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific results, conversion rates, or uptime, or that the services will meet your compliance obligations. Nothing here is legal advice.
Limitation of liability
To the maximum extent permitted by law, Ventix will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of the services will not exceed the amounts you paid us for the services in the three (3) months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold Ventix harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the services, your data, or your violation of these Terms or applicable law, including telemarketing and consumer-protection laws.
Term and termination
These Terms apply while you use the services. We may suspend or terminate access if you breach these Terms or use the services unlawfully. Provisions that by their nature should survive termination will survive.
Governing law and disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-laws principles. The courts located in Pakistan will have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief where appropriate.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last updated" date above. Your continued use of the services means you accept the updated Terms.
